Planning Scheme Amendment C284case - Casey Planning Scheme rewrite

The C284case Panel Report is now available at the link above. The public Planning Panel Hearing was held from 13 to 15 May 2024 to consider submissions. The Panel Report contains the Planning Panel's findings and recommendations. Council will consider the recommendations and make a decision about how to proceed with amendment later this year.

Community Information

The Casey Planning Scheme guides and regulates land use and development within the municipality. It is the framework by which Council and other authorised decision-makers (such as VCAT and the Minister for Planning) make decisions. An up-to-date planning scheme provides Council, the development industry, State Government and the community with contemporary strategic directions and clarity when preparing, assessing, and making decisions on planning permit applications and planning scheme amendment requests within Casey.

Amendment C284case is a review of the planning framework for the City of Casey and applies to the whole municipality . The Amendment updates the content and structure of the Casey Planning Scheme to meet state government legislative requirements . The Amendment also re-writes existing policies in the Scheme to reflect Council’s current strategic directions for land use and development and is informed by adopted Council strategies . In addition, the Amendment updates the background documents which have guided the preparation of the Amendment and corrects minor errors and anomalies in the Scheme to ensure that it can be readily understood and implemented.

The closing date for submissions was midnight on Friday 1 December 2023 .

Timeline

Timeline item 1 - complete Preparation of Amendment

At its meeting on 20 September 2022, Council resolved to seek authorisation from the Minister for Planning to prepare a planning scheme amendment .

Timeline item 2 - complete Authorisation of Amendment

The Minister for Planning authorised the preparation and exhibition of Planning Scheme Amendment C284case on 4 May 2023. Council will need to address any authorisation conditions with Officers from the Department of Transport and Planning prior to exhibition.

Timeline item 3 - complete Exhibition of Amendment

Consultation on the Amendment will open on Thursday 19 October 2023 and will close at midnight on Friday 1 December. Anyone can make a submission in support of the amendment; explain why they may oppose the amendment; or request a change to the amendment.

Timeline item 4 - complete Consideration of submissions

Council considered all submissions on 19 March 2024 and resolved to request the Minister for Planning appoints an independent Planning Panel to provide advice to Council on how to proceed with Amendment C284case.

Timeline item 5 - complete Planning Panel – Directions Hearing - 19 April 2024

If submissions are received from the community which Council cannot resolve, Council will request the Minister for Planning to appoint an independent Planning Panel. The directions hearing is a procedural hearing which outlines how the public hearing is to be run and occurred on 19 April 2024.

Timeline item 6 - complete Planning Panel – Public Hearing - 13-15 May 2024

The Planning Panel hearing is scheduled to start in the week commencing 13 May 2024 where the Panel will hear submissions from Council and any submitters. All written submissions to the amendment will be considered by the Panel, whether the submitter has requested to be heard or not.

Timeline item 7 - complete Panel report received by Council

A Planning Panel was appointed to consider submissions to the amendment and they produced a Panel Report with recommendations that can be found here. Council will consider the recommendations and make a decision about how to proceed with the amendment.

Timeline item 8 - incomplete Decision by Minister for Planning

Council submits the Amendment to the Minister for Planning for approval. The Minister has the final say and will decide on the Amendment. Council will share the decision with the community.
